The interrelationship and complexity of family life and its legal aspects brings to bear other areas of law such as constitutional law, contract law, property law, and estate planning, all within the practice of family law.
At Reddy Law Firm, we are dedicated advocates for our clients and provide quality representation in a wide variety of family law matters such as:
When most people think of family law, the first things that comes to mind is divorce. However, individuals with sizable incomes or assets should take advantage of a wide range of family law services such as pre-nuptial and post-nuptial agreements, co-habitation agreements, guardianships, and early estate planning.
When appropriate and with the goal of reducing the stress associated with family law matters, the attorneys at Reddy Law Firm will seek to resolve issues through mediation in order to faciliate a successful outcome reached through consensus and resolution. However, recognizing that negotiation can sometimes be futile thereby making mediation no longer an option, Reddy Law Firm offers zealous, respectful advocacy on behalf of clients for the most optimal settlement.
Divorce
Indiana is a no-fault divorce state which means that a divorce does not require proof of wrongdoing by the other spouse. Grounds for divorce in Terre Haute (link to new divorce page) can simply be that the marriage is irretrievably broken. Once divorce proceedings are filed, the Court must wait at least 60 days before finalizing the divorce. Divorce proceedings may take much longer depending on whether children are involved, the interest of the parties in a quick resolution, the amount of assets involved, and the complexity of other issues. At Reddy Law Firm, we understand how stressful a divorce can be and are prepared to provide aggressive representation while being supportive and sensitive to your situation. We strive to provide the best outcome not only for you, but for your family.
Child Custody
Issues involving child custody, child support and visitation are typically decided either by the Court or by the parents as part of the divorce settlement agreement. Child custody is determined based upon what is in the best interest of the child and includes an analysis of several factors. There are several types of child custody arrangements depending upon the client’s unique situation.
At Reddy Law Firm, we are prepared to negotiate, enforce, and modify child custody arrangements for the benefit of our client and their children.
Child Support
A divorce agreement should provide for adequate child support in order to meet a child’s financial needs. In Indiana, child support is determined based upon the child support guidelines which factors the income, expenses, and debts of both parents.
At Reddy Law Firm, we are prepared to enforce child support payments and seek modification when there has been a change in circumstances requiring a modification.
Pre-Nuptial/Post-Nuptial Agreements
Pre-Nuptial and Post-Nuptial agreements have several purposes such as ensuring that assets are distributed according to the client’s wishes, protecting assets from a spouse, protecting the interest of children from a previous marriage, identifying assets acquired before and during a marriage, and hopefully, avoid litigation over the division of assets in the event that a divorce occurs.
At Reddy Law Firm, we are available to prepare pre- and post-nuptial agreements based upon the client’s wishes.
Co-Habitation Agreements
Co-habitation Agreements are necessary when an un-married couple lives together, jointly own property and/or are considering investing in property together. There are numerous reasons why people may want or should have a co-habitation agreement. Opposite sex couples may want to gain greater property protection than they have in the un-married status. Same sex couples often want to create a marital type union which can only be done through contracts, wills, trusts, and beneficiary designation. Co-habitation agreements are useful in determining how to divide property in the event the relationship ends, especially since there is not a marriage dissolution statute which applies.
At Reddy Law Firm, we are available to prepare co-habitation agreements to meet your unique set of circumstances.
Guardianships
A guardianship is the court ordered management of the affairs of an individual who is no longer capable of managing his/her own affairs. Taking on the role of a guardian is a tremendous responsibility and should not be taken lightly. At Reddy Law Firm, we can provide assistance with incapacity hearings, the appointment of a guardian, advising guardians on their legal responsibilities and obligations, preparation of annual reports to be filed with the court, the termination of a guardianship, and any other matters relating to guardianships.
